That such a stipulative artifice is required to capture the intuitive moral phenomena, however, suggests that these phenomena are in truth explained by moral principles that do not hinge on victim foreseeability at all. In any event, even if the Palsgraf principle helps itself to this artificial sense of victim foreseeability, the principle cannot ultimately be saved. For the Palsgraf principle is not, at bottom, about victim foreseeability (or plaintiff foreseeability) at all. Rather, the principle maintains that a plaintiff must be wronged — must be treated carelessly or otherwise wrongfully by the defendant — in order to recover. Plaintiff unforeseeability is simply one sort of factor that precludes a defendant from treating the plaintiff carelessly, from breaching a duty to be careful toward her.
